TRAVEL RETAILER DISCLOSURE

Most US states have adopted insurance rules and regulations which regulate the activities of retailers offering travel insurance programs. A registered Travel Retailer is authorized to operate under, and on behalf of, another entity with a Limited Lines Travel Insurance Producer (“LLTIP”) license, such as InsureStays, if the Travel Retailer agrees to adhere to basic guidelines and consumer protections.

In states that have not adopted an authorization process which permits Travel Retailers to operate under an LLTIP entity, Travel Retailers must possess the appropriate license(s) in order to transact travel insurance business. If they do not, they may only refer interested parties to appropriately licensed agents.

You should know the travel protection plans offered and disseminated by authorized Travel Retailers of InsureStays or sold by InsureStays provide insurance coverage that only applies during the covered trip. You may have coverage from other sources that provides you with similar benefits but may be subject to different restrictions depending upon your other coverages. You may wish to compare the terms of this policy with your existing life, health, home, and automobile insurance policies as well as any other insurance protection plans you may have coverage under. If you have any questions about your current coverage, call your insurer or insurance agent or broker.

Purchasing travel insurance is not required in order to purchase any other product or service offered by the Travel Retailer. As an authorized Travel Retailer of InsureStays, no employee of the Travel Retailer is qualified or authorized to:

(a) Provide technical explanations, representations, or interpretations, or answer technical questions about, coverage provisions, benefits, exclusions, terminology and/or conditions of any of the insurance policies sold by InsureStays;

(b) Evaluate the adequacy of the prospective insured’s or travel/rental guest’s current existing insurance coverage;

(c) Otherwise advertise, hold out or present themselves in such a way as to be perceived as a fully licensed agent or as an insurance expert.

Travel Retailers are not licensed insurance producers, agents, or insurance experts. Travel Retailers may only provide general information such as a description of the coverage provided and the price. Travel Retailers can also process your application and collect your premiums. Travel Retailers cannot answer specific questions about your policy. Any questions you have about your policy, including coverage, benefits, exclusions, terminology, and/or conditions should be directed to InsureStays and/or to the insurance carrier underwriting the policy.

  2. If not individually licensed, that the Travel Retailer's employee is not qualified or authorized to:

  2. Purchasing travel insurance is not required in order to purchase any other product or service offered by the Travel Retailer. If not individually licensed, the Travel Retailer’s employee is not qualified or authorized to:

(a) evaluate or interpret technical words or phrases used in a travel insurance policy or benefits under or terms of the policy;

(b) Evaluate or provide advice related to a traveler’s existing insurance coverage; or (c) be considered as a license holder or an insurance expert.

NOTICE TO NEW YORK RESIDENTS

The licensed producer represents the insurer for purposes of the sale. Compensation paid to the producer may depend on the policy selected, or the producer's expenses, volume of business, or profitability. The purchaser may request and obtain information about the producer's compensation, except as otherwise provided by law.

NOTICE TO MARYLAND RESIDENTS

The purchase of travel insurance would make the travel insurance coverage primary to any other duplicate or similar coverage. The Commissioner may be contacted to file a complaint at: Maryland Insurance Administration, ATTN: Consumer Complaint Investigation Property/Casualty, 200 St. Paul Place, Suite 2700, Baltimore, MD 21202.

 

NOTICE REGARDING LICENSING & PREMIUM TRUST ACCOUNTS: 
Insurance-Regulatory authorities generally require (1) that individuals and entities selling insurance are appropriately licensed/ authorized, and (2) that individuals and entities taking, receiving, holding, or otherwise collecting premium or coverage payments, made by insured’s or coverage-holders to insurers, providers and/or their designated agents, hold those monies in a designated trust account on behalf of the insured/coverage-holders; and to transmit all monies due to insurers, providers and/or their designated agents immediately upon being invoiced by the insurer, provider or designated agent for timely payment.

NOTICE REGARDING RIGHT TO SUSPEND ACCOUNT FOR NON-COMPLIANCE:

Both InsureStays and RentalGuardian.com reserve the right to suspend or de-activate any previously-activated Retailing Account in the event (1) that the underwriter or carrier determines that the Account is ineligible for coverage and/or participation in the program, or (2) that evidence of appropriate licensing and authorization is not provided to InsureStays in a timely manner; (3) that any retailing Account-holder is found to be in violation of known insurance regulations; (4) that anyone employed by and/or managed by the retailing account holder are in violation of Section 1033 of Title 18 of the United States Code* which prohibits ineligible persons from participating in the business of insurance.
