Overview and Agreement
This Privacy Policy (“Privacy Policy”) applies to all “Personal Information” (as defined below) provided by you via use of this website and/or the online services provided via the Site (the “Services”) and constitutes an agreement between you and InsureStays (“Company,” “we” or “us”). ie
Online privacy concerns focus on the protection of “Personal Information” from unauthorized use. As the term suggests, “Personal Information” is information which can be associated with a specific individual or entity, including, for example, a user’s name, address, or telephone number, e-mail address, photograph, driver’s license information, social security number, bank or other account information any other identifier that permits the physical or online contacting of a specific individual, and information about a user that is collected and maintained in personally identifiable form in combination with other Personal Information.
Company has adopted consistent data protection and data security standards for processing the Personal Information of its clients, partners, prospects, and employees. Company holds responsibilities for protecting the privacy of Personal Information, including any personal information being maintained, against threats posed by unauthorized access or misuse. In addition, Company respects individual privacy and shall handle all Personal Information with care.
This policy supports Company’s ability to adapt to a changing marketplace and forms the basis for long-lasting relationships built on trust. This statement also sets important basic conditions for the exchange of data, and a reasonable level of data protection for data flows.
This policy applies to Company as well as associated companies and their employees and covers the following: collection, storage and use of Personal Information relating to clients, partners, Company employees, and prospects. This includes data relating to customers, prospects, suppliers, and other third parties. You consent and agree to the collection, storage and use of Personal Information provided by you in accordance with the terms of this Privacy Policy.
Company reserves the right to change the Privacy Policy by publishing new terms on the Site at least thirty (30) days before the effective date of the changes, and your access and use of the Company website or online services thereafter constitutes your acknowledgment and acceptance of same.
Personal Information We Collect
The data we collect depends on the context of your interactions with Company, the choices you make, and the products and features you use. The data we collect may include the following:
User-Reported Information: Company collects Personal Information of its clients, prospects and third-party service providers to facilitate customer support, sales, marketing and related operations essential to Company. Company collects information you provide to us such as contact information including name, email address, phone number, and similar data, the content of messages you send to us, such as feedback and product reviews you write, or questions and information you provide for customer support. When you contact us, such as for customer support, phone conversations or chat sessions with our representatives may be monitored and recorded.
Applications: Using Company’s applications, information can be processed on an organization’s own computers or on computers hosted by Company. In the latter case, Company is an Application Service Provider (ASP). The sign-up process for creating an account for certain applications requires you to provide us with personal contact information. We may also collect certain financial information to create and maintain your account (including without limitation, rent payment amounts and bank account and credit card information).
The types of Personal Information collected at these application pages may include:
- Name
- Address (e.g. for billing and shipping)
- Email address
- Phone number
- Payment card/account information
- Property address
- Other information which is required to complete your request or transaction using the Services or otherwise fulfill your request, which may include personal identification information such as social security number, driver’s license number and similar information.
- Other information as agreed upon through separate Terms of Use/Terms and Conditions specified to the application, where applicable.
System Information/Cookies: Cookies are small bits of code, usually located on a user’s computer hard drive or device, which store information about your visit, your preferences and settings, enable sign-in, provide interest-based advertising, combat fraud and analyze how our websites and online services are performing. We may use cookies and other means to collect Personal Information about your online activities over time and across different websites when you use the Site or the Services. We may automatically collect and store:
- information about devices you use to access the Services and how you use the Services, such as your Internet Protocol (“IP”) address and which websites you visited before accessing our Services.
- certain information such as pages viewed, the date, time and length of time spent on the Site, computer and connection information such as browser type and version, operating system and platform, and other transactions performed on the Site.
- If you access the Site through a mobile device, we may also be able to identify the device ID and location of your mobile device. You may choose not to share your location details with us by adjusting your mobile device’s location services settings. How We Use Personal Information
As a policy, Company uses Personal Information only in ways that are compatible with the purposes for which it was collected or subsequently authorized by the individual.
You agree that we can use your Personal Information as described in this Privacy Policy, to:
- Enable, support and customize your use of the Site and/or our products, applications or services;
- provide you with updates and information about our products and services;
- conduct analysis for our business purposes; support development and marketing of our products and services including but not limited to the development and commercialization of new products and services; and
- create de-identified information and then use and disclose this information in any way permitted by law, including to third parties in connection with their commercial and marketing efforts.

First Party Cookies. We use cookies to improve your web-browsing experience. For example, we may use a cookie to reduce the time it takes for you to submit requests by storing a registered user’s e-mail address so that the user does not need to enter their e-mail address each time that they log-in to the Site. We will also use a cookie to keep track of your search criteria while you are using the Services. Our cookies are associated with a user’s Personal Information. However, no third party may use the information we collect through our cookies for their own purposes.
We use cookie and system information in the aggregate only to diagnose problems with our service, to improve and track the success and to provide content of interest to you.
If you’d rather that Company not use cookies when you visit our website or use our online services, you can configure your browser settings to reject cookies, but doing so may cause some of the Services on the Site to not work properly.
Do Not Track Signals: Company’s website and online services are not currently configured to respond to Do Not Track signals or other mechanisms that provide users the ability to exercise choice regarding the collection of Personal Information about a user’s online activities over time and across third party websites or online services.
Use by Children: Company, as a standard practice, does not knowingly or specifically collect, use, or require any information about minors under the age of 18. The website(s) run by Company are not intended for minors under the age of 18. If you believe that we have mistakenly or unintentionally collected such information, please notify us so that we may delete the information from our servers.
Business Partners and Affiliates: We may share your personal information with non-affiliated third-parties as necessary for us to provide the product or service you, as permitted by law, or as otherwise specified herein. We may also provide all of the types of Personal Information listed above to one or more of our affiliated companies in connection with our services and other business purposes.
Sharing of Information
You agree that we may disclose your Personal Information to third party contractors that assist us by performing services related to operation of the Site and/or the Services. If it is necessary to disclose your Personal Information to third parties, Company will obtain assurances from the recipients that they will safeguard Personal Information consistently with this Privacy Policy. Examples of appropriate assurances that may be provided by recipients include but are not limited to: a contract obligating the recipient to provide at least the same level of protection as is required hereunder and/or under applicable legal and industry requirements such as PCI DSS. Where Company becomes aware that a recipient is using or disclosing Personal Information in a manner contrary to this Privacy Policy, Company will take reasonable steps to prevent or stop the use or disclosure. We may also provide the types of Personal Information listed above to one or more of our affiliated companies in connection with our services and other business purposes.
Law Enforcement/Legal Disclosure: Additionally, notwithstanding any other provision contained herein, to the extent permitted or required by law, regulation or other legal requirement, we will disclose your Personal Information to government authorities or third parties if:
- required to do so by law, or in response to a subpoena or court order;
- we believe in our sole discretion that disclosure is reasonably necessary to protect against fraud, to protect the property or other rights of us or other users, third parties or the public at large; or
- we believe that you have abused the Site by using it to attack other systems or to gain unauthorized access to any other system, to engage in spamming or otherwise to violate applicable laws or in violation of our Site Terms of Use. Non- U.S. Users
The Site and the Services are directed to users located in the United States. If you are located outside of the United States and you choose to use the Site or the Services or provide your Personal Information to us, your Personal Information may be transferred to, processed and maintained on servers or databases located in the United States. Your use of the Site and/or the Services represents your consent and agreement to these practices. If you do not want your Personal Information transferred to or processed or maintained in the United States, you should not use the Site or the Services. In the case that Personal Information is transmitted to Company by you, you must ensure that the Personal Information has been collected in accordance with the applicable legal requirements, and that the use of such Personal Information for the intended use is permitted.

Company informs individuals about the type(s) of Personal Information it collects, the purposes for which it collects and uses Personal Information, and the types of non-agent third parties to which Company discloses or may disclose information, and the choices and means, if any, Company offers individuals for limiting the use and disclosure of their Personal Information. Notice will be provided in clear and conspicuous language before individuals are first asked to provide Personal Information to Company, or as soon as practicable thereafter, and in any event before Company uses or discloses the information for a purpose other than that for which it was originally collected.
Information Security and Confidentiality
We have implemented technology and security features, methods and processes in an effort to safeguard the privacy of your Personal Information from unauthorized access or improper use, and we will seek to continue to enhance its security procedures as new technology becomes available. All Personal Information is treated confidential; any unauthorized collection, processing, or use of such Personal Information is prohibited. In the context of increasingly flexible company organization, it must be ensured that employees have access to Personal Information on a need-to-know basis. The need-to-know principle means that employees may have access to Personal Information only as is appropriate for the type and scope of the task in question. This requires a careful breakdown and separation, as well as implementation, of roles and responsibilities. Nevertheless, you acknowledge and agree that perfect security is not possible, and your Personal Information could still be accessed and used by others without authorization.
Personal Information that is no longer needed for its intended purpose will be deleted in compliance with Company’s existing data retention policy.
California Privacy Rights
Under California law, California residents may request once a year, free of charge, certain information regarding our disclosure of personal information to third parties for direct marketing purposes. If you are a California resident, you may make such a request by sending an email to privacy@insurestays.com with “California Privacy Information Request” on the subject line.
Other Web Sites
This Privacy Policy only applies to the Site and Company’s Services and your Personal Information submitted to the Site or via the Services. The Site may link to third party websites and information or service providers that may collect Personal Information from you in order to provide you with information or fulfill Product orders placed by you. Advertisements that may appear on pages on the Services may also request Personal Information or provide you with access to other sites that request Personal Information. We have no control over the Privacy Policy of any third party or other website. Their privacy policies may differ, or they may have no privacy policies. Please examine the privacy policies of such third parties prior to submitting any Personal Information, as they may differ from ours.
Business Transfers
Business Transfers: We may share the information we collect, including personal information, with any third party in connection with, or during negotiations of, any proposed or actual merger, purchase, sale (including a liquidation, realization, foreclosure or repossession) or any other type of acquisition of all or any portion of Company assets, conveyance or transfer of all or a portion of our business to another company. During the quoting, application, or claims handling processes you may give us information such as:

- If you give us your email address, InsureStays may use it from time to time to notify you of such things as service support or to confirm transactions.
How/Where Do We Collect The Information?
We obtain personal information from you directly, from your transactions with us, and from third parties such as travel agents, online booking service providers, online property listing sites, property managers, and furnished accommodations providers.
We do not collect personally identifying information from you when you visit our website or other online services unless you affirmatively provide it to us.

We collect information from InsureStays Mobile Apps and via other Online channels.
We collect information about you from analytics providers such as Google, which includes the following:
- your gender;
- your age;
- your language of preference;
- your interests;
- your location via IP addresses;
- your internet provider;
- your computer’s operating system;
- your web browser; and
- your behavior on the website, such as how long you have spent on each page, how you got to the page, and whether you are a new visitor.
We collect information from search information providers.
We collect information from Third Parties; we may collect information about you from third parties such as:
- your insurance intermediary or other organizations providing services to them;
- other insurers (directly or using shared databases such as a register of claims);
- other third party databases which have been established to help detect and prevent fraudulent activity; and
- other publicly available sources such as social media, commercially available sources and information from our affiliates or business partners.
We will seek your permission to contact these people for your information.
We may collect Information about your transactions and experiences with us such as your payment history, travel itineraries, claims, coverage, and coverage changes.
How Do We Use The Information About You and Why We Do We Need It?
We use the Personal Information collected:
A.) In relation to any quotes requested, or your insurance products and services taken out:
- Communicate with you and others as part of our business;
- Send you important information regarding changes to our policies, other terms and conditions, and other administrative information;
- Provide quotes and make decisions about eligibility for insurance and assistance services, and other products and services which we offer, and provide such products and services, including claim support; and, where applicable, assist with claim disputes;
- Process your premium and other payments;
- Identify you to anyone to whom you send messages through any of the InsureStays online Services;
- Without the Personal Information collected we may be unable to administer your coverage, product or service.
B.) To ensure we are able to adhere to legislation and regulatory obligations such as to:
- Prevent, detect and investigate crime, including fraud and money laundering;
- Resolve complaints, and handle requests for data access or correction;
- Comply with applicable laws and regulatory obligations (including laws outside your country of residence), such as those relating to anti-money laundering, sanctions and anti-terrorism; comply with legal process; and respond to requests from public and governmental authorities (including those outside your country of residence);

How Do We Share Your Information Within InsureStays?
We may share and aggregate information about you from InsureStays and other companies related to the business of InsureStays including those commonly held by Rental Guardian Holdings.
The information we share internally may include personal information held within InsureStays relating to other coverage held with us, quotes or claims details and, depending on your preferences, we may use this information to:
- help us identify products and services that may be of interest to you, to tailor and package our products and services;
- determine pricing and/or offer available discounts; and
- conduct customer research and develop marketing campaigns.
If you request a quote, or purchase a product or service from us, your personal information will be used and shared within InsureStays for the purposes of administration (including underwriting, determining premiums, managing claims and offering renewals). We will use your information to communicate with you about your quote, product or service, including improvements we make to the ways you can access your information.
How Do We Share Your Information Outside InsureStays?
In the course of marketing, obtaining coverage (for instance if you request a quote, or purchase a product or service) and providing service and claims support, your personal information may be shared with and processed by InsureStays may make your information available to:
- Insurance and Distribution Parties
- Our associated companies, introducers, intermediaries, insurers, reinsurers, insurance and reinsurance brokers, and their agents or appointed representatives, other distributors, affinity marketing partners, financial institutions and securities firms as well as the policyholder (for a corporate policy) and your broker or agent for the purposes of administration (i.e. progressing a claim made by you), including third parties providing services to them, (as detailed above).
- Our service providers
- External third-party suppliers or service providers, such as medical professionals, accountants, actuaries, auditors, experts, lawyers and other outside professional advisors; travel and medical assistance providers; call center service providers; IT systems, support and hosting service providers; printing, advertising, marketing and market research and analysis service providers; banks and financial institutions that service our accounts; third-party claim administrators; document and records management providers; claim investigators and adjusters; examiners; jury consultants; translators; and similar third-party vendors and outsourced service providers that assist us in carrying out business activities, for example, to help administer your coverage, to help us manage and store data, provide data analytics, conduct market research and to communicate with you effectively. This may include any online or digital partners we work with, so we, or our online or digital partners on our behalf, can communicate with you through their platforms.
- Regulatory bodies
- Regulatory bodies [in the US overseas] as well as with other insurance companies (directly and via shared databases) to prevent and detect fraud.
- Governmental authorities and third parties involved in court action
InsureStays may also share Personal Information with governmental or other public authorities (including, but not limited to, workers’ compensation boards, courts, law enforcement, tax authorities and criminal investigations agencies) in response to lawful requests by such public authorities; and third-party civil legal process participants and their accountants, auditors, lawyers and other advisors and representatives as we believe to be necessary or appropriate:
(a) to comply with national security or other law enforcement requirements; (b) to comply with legal process;
(c) to respond to requests from public and government authorities including public and government authorities outside your country of residence;
(d) to comply with applicable law, including laws outside your country of residence; (e) to enforce our terms and conditions;
(f) to protect our operations or those of any of our family of companies;
(g) to protect our rights, privacy, safety or property, and/or that of our family of companies, you or others; and
(h) to allow us to pursue available remedies or limit our damages.
We may share Personal Information with payees; emergency service providers (fire, police and medical emergency services); retailers; medical networks, organizations and providers; travel carriers; credit bureaus; credit reporting agencies; and other people involved in an incident that is the subject of a claim; as well as purchasers and prospective purchasers or other parties in any actual or proposed reorganization, merger, sale, joint venture, assignment, transfer or other transaction relating to all or any portion of our business, assets or stock.
InsureStays may disclose your Personal Information as described above, but only in good faith and for the limited and specified purposes described in this notice.
InsureStays will only share your information for marketing purposes outside InsureStays where you have consented to marketing.
In the event we share your Personal Information, we will take appropriate measures to protect your privacy and the Personal Information we transfer.
We require all third parties to respect the security of your Personal Information and treat it in accordance with the law. We do not allow our third party service providers to use your Personal Information for their own purposes and we only permit them to process your Personal Information for specified purposes and in accordance with our instructions.
In addition, if we learn that third party is using or disclosing your Personal Information in a manner that is contrary to this Policy, we will take reasonable steps to prevent or stop such use or disclosure. InsureStays may be liable for onward transfers of Personal Information to third parties in violation of this Policy and the US Privacy Shield.
How Do We Handle International Transfers of Your Personal Information?
Due to the global nature of some segments of our business, we may transfer Personal Information to parties located in other countries including the European Economic Area (EEA), the United States of America, the Republic of India, and the Republic of the Philippines for processing, storage, administration or any other use stated within this Policy.
We may transfer Personal Information internationally to our group companies, service providers, business partners and governmental, regulatory or public authorities.
When we transfer your Personal Information overseas we ensure a similar degree of protection is afforded to it by ensuring one of the following safeguards:
- We will only transfer your Personal Information to countries that have been deemed by the relevant data protection regulatory bodies to provide an adequate level of protection for personal information
- Where we use certain service providers we may use specific contracts approved by data protection regulatory bodies.
- Where we transfer data to our group companies we require all of our group companies to follow the same rules as InsureStays when processing your Personal Information
- The purposes and processing associated with any such transfer will comply with all applicable data protection regulations, including, for all EU residents, the EU’s General Data Protection Regulation, if and where we participate in the U.S. Department of Commerce’s EU Privacy Shield (“Privacy Shield”). We are committed to ensuring that all Personal Information received from the EU in reliance on the Privacy Shield, is subject to the Principles. If there is any conflict between this Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern in matters regarding EU residents. - Further, please note that any communication you send to an “insurestays.com” e-mail address will be routed through the United States.
What Are Our Marketing and Opt-Out Policies?
You will receive marketing communications from us if you have requested information from us or obtained insurance products and services from us / our authorized retailers and in each case you have not opted out of receiving that marketing.
We will get your express opt-in consent before we share your Personal Information with any company outside the InsureStays group of companies for marketing purposes.
You can ask us or third parties to stop sending you marketing messages at any time by contacting us. Where you opt out of receiving these marketing messages, this will not apply to Personal Information provided to us as a result of a product or service you have purchased from us, your product/service experience, or other transactions.

How Do We Keep Your Information?
InsureStays will only process Personal Information in ways that are compatible with the purpose for which InsureStays collected it, or for purposes which you might later authorize. We will only keep your information for as long as is necessary and in accordance with any relevant regulatory, accounting or reporting requirements.
To determine the appropriate retention period for Personal Information we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use of disclosure, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.
Before we use your Personal Information for a purpose that is materially different than the purpose we collected it for or that you later authorized, we will provide you with the opportunity to opt out.
InsureStays maintains procedures to help ensure that Personal Information is necessary for its intended use, accurate, complete, and current.
How Do We Safeguard Information Security?
InsureStays will take appropriate technical, physical, legal and organizational measures, which are consistent with applicable privacy and data security laws. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any Personal Information you might have with us has been compromised), please immediately notify us at stayinfo@insurestays.com. When InsureStays provides Personal Information to a service provider, the service provider will be selected carefully and expected to use appropriate measures to protect the confidentiality and security of the Personal Information.
We will put in place procedures to deal with any suspected Personal Information breaches. We will notify you and any applicable regulator of a breach when we are legally required to do so.
What Are Your Rights?
Your rights include the following:
- Right to access, rectification, and erasure:
- You may have the right to access the Personal Information that we hold about you and to request that we correct, amend, or delete it if it is inaccurate or processed unlawfully. These access rights may not apply in some cases, including where providing access is unreasonably burdensome or expensive under the circumstances or where it would violate the rights of someone other than the individual requesting access. - You have the right to data portability in certain circumstances, which allows you to obtain and reuse your personal information for your own purposes across different services thus allowing you to move, copy or transfer your personal information easily from our IT environment to another third party in a safe and secure way.
- Right to object:

- Right to withdraw consent at any time:
- Where you have provided consent to the processing of your information (for example, to the processing of your medical/health information), you have the right to withdraw your consent at any time. If you withdraw your consent we may not be able to provide certain products and services to you. - Right not to be subject to automated-decision making:
- As we use systems which make decisions based on automated processing of your information, you have the right to obtain human intervention, express your point of view and to obtain an explanation of the decision and challenge it.
- Right to lodge a complaint:
- You can make any of the requests set out above, or file a complaint about how we have handled your information. Please do not hesitate to contact us using the contact details provided above to ensure that it is resolved without delay. Please note that in some cases we may not be able to comply with a request you have made for reasons such as our own obligations to comply with other legal or regulatory requirements.
